ANSECO Group, LLC and ANSECO Group (HK) Ltd. herein called “ANSECO Group”, except where noted, will carry out, at the request of the Client, the required tests subject to the following conditions:

 

General Information Section

1. There will be a minimum charge of USD $75.00 (ANSECO-US) and HKD $200 (ANSECO-HK) per Test Report issued. All prices are subject to change without prior notice.

2. Official working hours are from 8:30 am to 5:00 pm Monday to Friday (ANSECO-US) and 9:00 am to 6:00 pm Monday to Friday (ANSECO-HK). Saturdays, Sundays and Public Holidays are not considered as working days.

3. Samples are accepted and temporarily stored in ANSECO Group provided that either they are insured by the Client or the Client assumes entire responsibility for loss or damage arising directly or indirectly in the course of analysis or handling, without recourse whatsoever to ANSECO Group or any member of its staff.

4. Client represents that the samples and related information furnished are being relied upon by ANSECO Group without verification by ANSECO Group relative to accuracy and completeness. Client agrees to hold ANSECO Group harmless and to indemnify ANSECO Group from any liability if the samples or information provided by Client are inaccurate or incomplete.

5. A Test Report will refer only to the sample(s) tested and will not apply to the bulk, unless sampling has been carried out by ANSECO Group, and it will be stated as such in the Report.

6. A Test Report will be issued in confidence to the Client and it will be treated as such by ANSECO Group. It may not be used for advertising without prior written consent from ANSECO Group.

7. ANSECO Group will generate a written Test Report intended for the Client’s exclusive use. Any copying or replications of the Report to or for any other person or entity, or use of our name or trademark, is permitted only with our written permission. The Test Report is limited to the test samples identified therein. The results set forth in the Report are not necessarily indicative or representative of the statistical quality or characteristic of the lot from which test samples were taken or any similar or identical product unless specifically and expressly noted. You shall have thirty days from receipt of the Report to request additional testing of the samples (ANSECO-US) or to notify us of any errors or omissions relating to our Report; provided however, such notice shall be in writing and shall specifically address the issues you wish to raise. A failure to raise such issues within the prescribed time shall constitute your unqualified acceptance of the completeness of the Report, the tests conducted and the correctness of the Report contents.

8. Applicants who wish to use ANSECO Group’s Test Report(s) in court proceedings shall inform ANSECO Group prior to submitting the sample for testing.

9. In the event that any Test Report shall be proved to be inaccurate and that the inaccuracy thereof shall have been caused by the act of default of ANSECO Group or its servants or agents, the liability of ANSECO Group therefore shall be limited to refunding to the client for whom the Test Report shall have been made, free of interest, the fee paid to ANSECO Group for the Test Report, and in no circumstance shall ANSECO Group be liable to compensate or indemnify the client for whom such Test Report shall have been made or any third party whomsoever for or in respect of any consequential loss or damage sustained by any such party as a result of the inaccuracy of such Test Report.

10. Client understands and agrees that the testing contemplated by these Terms and Conditions, including sample preparation and related activities, may damage, destroy or alter Client’s product, and Client agrees to release ANSECO Group from any claims or responsibility therefore.

11. In the event of improper use of the Report, ANSECO Group reserves the right to withdraw it, and to adopt any other measures which may be appropriate.

12. The agreement or undertaking of which these Terms and Conditions are a part shall be governed by and construed under the laws of the State of New York. (ANSECO-US)

13. By submitting a request for services to ANSECO Group, the client consents to the disclosure to accreditation bodies of those records of client, relevant to the accreditation body’s assessment of ANSECO Group competence and compliance with relevant accreditation criteria.

14. It shall be the responsibility of the Client to advise ANSECO Group of the country/countries in which the samples submitted for testing are intended to be sold.

15. Payment terms shall be net thirty (30) days from the date of invoice, unless otherwise agreed upon in writing.

 

Sample Storage & Return

16. Samples will be stored for a period of 30 days. (ANSECO-US) One reference sample will be stored for a period of 30 days. (ANSECO-HK)

17. The shipping costs for returning samples shall be the responsibility of the Client. (ANSECO-US)

18. Self-collect samples shall be picked up at ANSECO-HK’s laboratory within 5 working days after test report issued. (ANSECO-HK)

19. Samples returned by, and at the convenience of ANSECO-HK, will be charged HKD $150.00 per trip. (ANSECO-HK)
